bxe saving broken

in the default publication, open index.html for editing with bxe, and 
try to save.

Document couldn't be saved
XML Parsing Error: mismatched tag. Expected: . Location: 
http://localhost:8888/default/webdav/index.xml?exit=true Line Number 
410, Column 91:

Apache Cocoon 2.1.10-dev

this happens in different documents across different publications, so i 
suspect the problem lies in the webdav module.
