Are you using the latest sshd version ?
I can see the destroy() methods being called on the command on a client timeout, which calls the inverted shell wrapper's destroy() method.

I've added a unit test in http://svn.apache.org/viewvc?view=revision&revision=1387190 and it works correctly.
