This is exactly what overwrite is meant to do. 

Copy has two modes
-copy only if source file is newer than the dest (overwrite=false)
-copy even if dest file is newer than the source (overwrite=true)

What you seem to want is 'overwrite only if the dest file doesnt exist'. To do
that, use a <selector> in the fileset to only copy files that dont exist at the
destination.
