I've tried to replicate this issue with following steps: 
 * Go to marketing > contact list screen.
 ** Created a private contact list with is_public = "N".
 ** Go to website menu and select available website Ids and create it.

*Current Behavior:* System allowed to associate the private contact list to selected website.

Here is the reference screenshot :
