XML Assertion

I use XML assertion to check the result of a SOAP/XML-RPC request.

But in the log file I have the follwing entries even with correct XML response.
This happen some times but not for all requests.

<httpSample t="24906" lt="24008" ts="1119880008540" s="false" lb="SynchroReferencielleServlet" rs="200" rm="OK" tn="Groupe+de+Thread+1-142" dt="text">
  <assertionResult>
    <failure>true</failure>
    <error>false</error>
    <failureMessage>Error in building: FWK005 parse may not be called while parsing.: FWK005 parse may not be called while parsing.</failureMessage>
  </assertionResult>
</httpSample>
<httpSample t="42239" lt="41404" ts="1119880008540" s="false" lb="SynchroTechnicienServlet" rs="200" rm="OK" tn="Groupe+de+Thread+1-3" dt="text">
  <assertionResult>
    <failure>true</failure>
    <error>false</error>
    <failureMessage>Error in building: Ill-formed XML document (multiple root elements detected): Ill-formed XML document (multiple root elements detected)</failureMessage>
  </assertionResult>
</httpSample>

I think the first errror is a Jmeter bug. I found that searching with google:
http://saloon.javaranch.com/cgi-bin/ubb/ultimatebb.cgi?ubb=get_topic&f=31&t=002008

For the second error, the XML result is correct and has not multiple root.
