I've been pinged about this at ApacheCon Core and have spoken to a number of board members who are present at the conference. The consensus of those board members (Rich, Shane, Bertrand, David) is that the initial text at the beginning of section 7.3 "Except for the distribution of freely available Licensed Applications..." applies to all of section 7.3 and therefore does not prevent the ASF from distributing source and/or binaries for apps via alternative distribution channels. Note that there is actually little/no point distributing binaries via alternative channels since users won't be able to install them.

I've checked on the current status of our application and it has essentially timed out. I have therefore taken the following actions:

1. I have updated the name of the root@a.o Apple account to the current V.P. Infra
2. I have updated the contact address to the 1901 Munsey Drive address
3. I have removed the telephone number

I plan to start the enrollment process again. I will agree to anything we have previously agreed to. If one of the agreements includes terms similar to 7.3 described above (it is posisble that the agreements have changed over the last 12 months) I intend to proceed under lazy consensus (i.e. 72 hours from now) based on the guidance received from the board members described above.

Update: Reading this I spotted a rather important typo that I have now fixed. The board members above were of the view that 7.3 does NOT prevent the ASF distributing via other channels.
