I think this probably shouldn't be closed until the build is brought up to javacc 5.0.

I think it is a good idea to bring Derby up to javacc 5.0 for our build after the 10.8  as long as the license hasn't changed in a problematic way.

Zied I would strongly suggest running regression tests before considering this fixed even in your own environment. Just because Derby builds with the patch, doesn't mean that it will run properly in all cases.
