decoding the tech-spec
why doesn't the URL in
<fo:root xmlns:fo="http://www.w3.org/XSL/Format/1.0">
work?
or is it returning something that IE 5.0 can't handle?

Because it's not a URL, it's a URI and is used as the unique identifier
which represents the XSL Formatting Object namespace.
