The code that you are suggesting should be changed will only be reached if the
controller config 'locale' setting is set to true. From the DTD for that config
setting:

     locale          Set to "true" if you want a Locale object stored in the
                     user's session if not already present.
                     [true]

In order to conform with this, Struts *must* create the session if it doesn't
exist. If, on the other hand, you don't want the locale stored in the user
session, you can set the 'locale' setting to false.
