[~jianhe], I intentionally wanted to keep the _merge_ function as a static utility function. I would prefer not adding a new constructor... Also, if you notice in the _KilledExternallyForReInitTransition_ we use this function to merge the existing ResourceSet and upgraded ResourceSet and set the value of container.resourceSet to the merged RS.
I can change it if your are particular... but would prefer to keep it as such.
