running in 10.9 without the order by's did not repro the problem.  ran 64 times against ibm15 SR15 and did not see it repro once.
I am happy to run any other suggested tests to show that this issue is not a code problem.  I agree with knut's analysis but would
feel better if I could cause the IO exception without the 10.10 code change.
