The idea here is when the region is tried to move away from the RS that holds the META, the region is actually closed. So the isClosed returns true.
The new check that is added to see if region is splittable internally checks for isClosed. But we are doing it on the older list of regions. We need to refresh the regions list. The failure will happen only when there is a movement of region takes places from RS having META to another RS.
